Are you worried about your Canadian study visa refusal? Don’t lose hope just yet! There is a powerful way to challenge your visa refusal through a judicial review in Canada’s Federal Court — and the best part is, you can do it without paying hefty legal fees. In this article, I’ll walk you through how this process works, recent changes in Canadian study visa requirements, and how Pioneer Immigration is here to support you every step of the way.
Many students choose Canada as their top destination for higher education. However, recent times have seen an increase in visa refusal rates, especially after the pandemic, causing understandable concern among applicants. But there’s good news: if your study visa is refused, you can challenge this decision by filing a judicial review in Canada’s Federal Court.
Through an exclusive arrangement between Pioneer Immigration and Canadian institutions, we ensure that your case is filed meticulously and correctly. If a refusal occurs, we will challenge it on your behalf with a strong legal approach. Importantly, this judicial review service is offered completely free of charge, which is remarkable considering that Canadian lawyers typically charge between 5,000 to 10,000 Canadian dollars for such cases.
Over the past year, several changes have been made to the study visa process that have left many students confused. Here are some key points to keep in mind:
GIC and SDS Categories: The SDS category has been discontinued. However, students can still submit funds through the Guaranteed Investment Certificate (GIC) route.
Proof of Funds: Students must show one year’s tuition fees plus one year’s living expenses. The best approach is to pay the one-year tuition fee directly to the institution and deposit the living expenses amount of CAD 20,635 into a Canadian bank as a GIC.
Alternative Payment Options: If a student prefers to pay tuition fees for only one semester instead of a full year, they need to show personal funds in their bank account that are at least four months old, not recent deposits.
It is crucial to ensure that any recent large deposits in the bank account have a genuine source, such as property sales or income from agricultural produce, with proper documentation like sale deeds or government-issued checks. This helps build a strong case and prevents the embassy from suspecting fund manipulation.
When demonstrating financial ability, funds can be shown from immediate family members such as siblings, parents, grandparents, and of course, the spouse. If the spouse is accompanying the student, additional funds from the spouse need to be shown. This is especially important for programs like master’s degrees or other degree programs.
